ZBA Meeting 11/2/2000 Report.

Subject: Receiving the documents regarding
the second appeal to the buffer zone for Flying J.
The first thing the board addressed was standing.
Do the three appellants have standing? Both Stan Kogut and
Elinor Currie were given standing just like the first buffer
zone appeal. Joe Oliver was not given standing the first
time, but he reapplied, because he was given standing in
another issue, where he was less impacted than in this case.
Ironically the board used Flying J's maps, created by Resource
Associates. They were supposed to show that the appellants
did NOT have standing. Instead they showed the ZBA that
Joe Oliver DOES have standing. Don't you just love it?
After the standing issue was resolved with
a five to one 'sort of' vote they moved on to Flying J's
use of the buffer zone. Again, Flying J documents created
by Resource Associates, were used to show that the structure
in question, was indeed a structure, because it was so marked
on the drawing. Somebody is going to be in hot water on
Friday when Flying J sees this... Again a five to one 'sort
of' vote to uphold Preble's laws and deny FlyingJShaferLawFirmResourceAssociatesDougStaleyTownBoard's
use of the buffer zone for their sewer system.
HOORAY!
Kudos to the ZBA for hanging tough in light
of the pressure from the Town Board. Nobody changed his
or her vote from last time. That took guts, but I think
that they knew they had the support from the people. The
last Town Board Special meeting showed clearly that the
Town Board had no support.
The actual vote takes place at 7 PM on the
13th of November just before the Town Board meeting
at 8 PM.
