ZBA Meeting 8/2/01 Notes

In attendance are Bob and Mouse Rittenhouse, their lawyer,
Dennis Morgan and Betty Ann Pitman. Everyone is sitting at
the back of the room. All four ZBA board members are here
and Sharon Flint, secretary is at her post.
7:40 Dan called the meeting to order. Three things on agenda.
(Turned out to be four.)
- Marsh sub-division public hearing was adjourned. They
may have withdrawn their application but Dan did not have
an official letter to that effect so they just adjourned
it for now.
- Shafer issue. No objection. Charley made a motion to have
the code enforcement officer issue a building permit. All
in favor. Unanimous.
- Dennis Morgan Application for his deck. Dan says they
can vote to do it because they have a super majority and
have a building permit issued. Dan spends a few moments
bringing Charley up to date because he wasn't at the last
meeting. Del expresses concern for a ramp entry, which Dennis
clears up for him. They are going to be putting a handicap
ramp on the side of the building. The deck on the front
removes the front entrance. They want the variance to cover
everything Dennis wants to do so he won’t have to
come back for more variances later. They make the variance
cover everything more or less in the 83-foot problem area.
Dennis mentions that the handicap ramp may be quite long.
They all vote for it. Unanimous.
- Rittenhouse sub-division. They are showing the details
of this to the ZBA to see if they think a variance is needed.
Discussion follows for a few minutes. Bob’s lawyer
says that this (sub-division) has been pending for over
a year. (Sure is different from the Knapp's rush job.)
Dan says it sure sounds like they have been aggrieved and
could come before the ZBA. Dan says he hasn’t gotten
anything from the Planning Board (Dean Smith) Bob's lawyer
says they had to redo the application because of having
to get the ok from the DEC. (Staley letter) Dan says that
he doesn’t think there is an issue for the ZBA to
get involved with. (Dean wanted to have the ZBA look at
it.) Dan got a letter from Staley today about the Army Corp
and a boundary dispute. Staley claimed they changed the
boundary by the lake without permission. (Not true.) Staley
still trying to delay Bob as usual. They make a motion to
say that there are no zoning issues for the ZBA. They all
vote for it, unanimous. They decide to send a letter to
Planning about it. Dan mentions a chain of command that
everything has to go through Staley before they can see
it. (The Town Board sure has given a lot of power to Staley.
And he sure is using it to his advantage. He is, after all,
just a contract worker, not an elected official.)
The meeting was adjourned and we left. Nice meeting.
