Two Florida legal organizations blast prosecutors in Limbaugh case

WEST PALM BEACH -- The Florida Attorney General's Office and the Florida Bar -- the two most powerful legal organizations in the state -- said Palm Beach County prosecutors misrepresented their advice in order to release confidential plea negotiations in the Rush Limbaugh investigation.

Both organizations said they felt they were used by State Attorney Barry Krischer.
Krischer is a democrat.
Assistant Attorney General Patricia Gleason, in a letter dated Wednesday to the state attorney's office, claimed Krischer's office had an ulterior motive.

"It seems to me that the purpose in contacting me about this issue may not have been to obtain impartial advice on an open government issue, but rather to use part of our conversation to justify your office's decision," she wrote. "This is disappointing to me personally and professionally."
The misuse of power does more than disappoint me.
Selvig also said Black should have been more clear that the negotiations discussed in the letters were confidential, even though they are noted as such.
The word CONFIDENTIAL was written across the top of the page. How much more clear does this partisan idiot need it to be?
Bar wants to correct record

Late Wednesday, the Florida Bar weighed in on the matter, faxing a letter to Limbaugh's attorneys reiterating what its records show: that in no way did the Bar tell Krischer he was ethically obligated to release the plea negotiations, McGrane, the Bar's president, said.

Krischer was asking for a legal opinion, which was beyond the scope of the Bar, he said. Like the attorney general's office, the Florida Bar said Krischer might want to seek a judge's advice, records show.

"We felt it was important to correct what was represented to the public," McGrane said.

Bruce Rogow, a law professor at Nova Southeastern University in Davie, said because of the released plea negotiation letters, problems might arise if Limbaugh is charged.

"It might very well create a situation where you have gross prosecutorial misconduct where the court might think about throwing the charges out," Rogow said.

Opinion: Political thoughts on the dems

I was listening to Dick Morris, former Clinton advisor and now a Fox contributer, on FoxNews tonight. He had an interesting theory. He said that the dems always put up a liberal nominee in Iowa and NH and then pick a moderate in the other primaries. The idea is that Kerry is the liberal pick and Dean is out and the moderate will be either Clark or Edwards. The moderate winner will beat Kerry and then become the nominee. It sounded plausible and does agree with me to the extent that I claim that Edwards will be the nominee for a completely different reason. I like people who agree with me, even if for a different reason. And if it does turn out to be Edwards I will be insufferable, or continue to be, as many people now think anyway.

Iraqi govt. papers: Saddam bribed Chirac - (United Press International)

BAGHDAD, Iraq, Jan. 28 (UPI) -- Documents from Saddam Hussein's oil ministry reveal he used oil to bribe top French officials into opposing the imminent U.S.-led invasion of Iraq.

The oil ministry papers, described by the independent Baghdad newspaper al-Mada, are apparently authentic and will become the basis of an official investigation by the new Iraqi Governing Council, the Independent reported Wednesday.

"I think the list is true," Naseer Chaderji, a governing council member, said. "I will demand an investigation. These people must be prosecuted."

Such evidence would undermine the French position before the war when President Jacques Chirac sought to couch his opposition to the invasion on a moral high ground.

Prosecutor rebuked over release of Limbaugh documents

The state Attorney General's Office rebuked a Palm Beach County prosecutor Wednesday for allegedly misrepresenting conversations between the two agencies to make it appear the AG had endorsed releasing sensitive plea-bargain documents about Rush Limbaugh to the public.

Palm Beach County State Attorney Barry Krischer released two pages of plea negotiations with Limbaugh last week in response to a public records request, along with a memo indicating that the agency had been advised by an Attorney General expert that the release was required by public-records law.

BBC Blamed for Broadcasting 'Unfounded' Allegations

LONDON, July 28 -- A judicial inquiry cleared Prime Minister Tony Blair on Wednesday of allegations aired by the BBC that he and his aides had exaggerated intelligence claims about Iraq's access to weapons of mass destruction and drove to suicide a British weapons expert who raised questions about those claims.

While exonerating Blair, Lord Brian Hutton blamed the BBC for broadcasting what he called "unfounded" allegations in May of 2003 that the government had published a "sexed-up" claim that Iraq could launch such weapons within 45 minutes of an order despite knowing it was probably wrong.

Hutton ruled that BBC editors did not adequately scrutinize the allegations before they were broadcast and that editors and senior officials -- including the BBC's board of governors -- failed to investigate after Blair and the government heatedly denied the report.

AL FRANKEN KNOCKS DOWN DEAN HECKLER

"EXETER, N.H. - Wise-cracking funnyman Al Franken yesterday body-slammed a demonstrator to the ground after the man tried to shout down Gov. Howard Dean.

The tussle left Franken's trademark thick-rim glasses broken, but he said he was not injured.

Franken - who seemed in a state of shock and out of breath after the incident - was helped back to his feet by several people who watched the tussle. Police arrived soon after.

"I got down low and took his legs out," said Franken afterwards."
This is the guy they picked to go up against Rush on the radio.

It makes me wonder why any of us pay any attention to these polls. I still haven't changed my mind about Edwards and the spinners are talking about a Kerry/Edwards ticket. Too soon for that, but they have to have something to call 'news' and to talk about. Now they will start talking about polls in the remaining states and who 'has' to win here and who will get out if they don't. Another week before all this is finally resolved is my wish, but I have this nagging feeling that this will drag on till the convention.

Just read the numbers and weep: of the 90 million Arab youth today (between the ages of 15 and 24), 14 million are unemployed, many of them among the 15 to 20 million Muslims now living in Europe. "There's not enough jobs and not enough hope," Jordan's King Abdullah told the Davos economic forum. According to the 2003 Arab Human Development Report, between 1980 and 1999 the nine leading Arab economies registered 370 patents (in the U.S.) for new inventions. Patents are a good measure of a society's education quality, entrepreneurship, rule of law and innovation. During that same 20-year period, South Korea alone registered 16,328 patents for inventions. You don't run into a lot of South Koreans who want to be martyrs.

I was at Google's headquarters in Silicon Valley a few days ago, and they have this really amazing electronic global map that shows, with lights, how many people are using Google to search for knowledge. The region stretching from Morocco to the border of India had almost no lights.

The level of ignorance in this statement is stunning coming from someone so high up at CBS. I'm utterly amazed that anyone of presumed intelligence could believe this.

Opinion: Political observations

I'm a observer, I watch people, the news, all kinds of stuff. I get a piece of information here, a hint there, and then sometimes, after a bit of time, it comes together. It's worked well for watching things in Preble and I've been using it to watch the goings on of the national scene too. I'm going to talk about my observations of the process the democrats are using to select a candidate for President. As a Republican I don't much care who they chose but if you watch as much TV news and listen to as much talk radio as I do it is impossible not to know something about what they are doing.

Let me give you some points of interest that have helped me understand what is going on. The first one is from just after the 2000 election, probably in January 2001 or so. I was watching Chris Mathews on Hardball, a MSNBC program, and they were discussing what the dems might do for the next election in 2004. Mathews used to work for a high ranking democrat whose name I can't remember and is a known dem with presumed contacts in the party. The question came up about Gore running again in 2004 and Mathews laughed and said words to the effect that the 'machine' only lets you have one try at it and Gore would not get another. Besides they were mad at Gore for losing what they thought he should have easily won. Remember that Gore had a 25 point lead going in and he even lost his own state. Florida would never have been an issue if he just won his own state. Anyway, the power boys at the dems were mad at Gore according to Mathews.

Now we fast forward to an event about a year ago in Florida hosted by the dems for some reason I also can't remember. Gore gave a speech that was memorable because he was sweating while giving it. And not just a little sweat either. He had his coat off and sweat was staining his shirt from his armpits down to his pants! This was very odd. It was Florida and every hotel has great air conditioning so why was he sweating at this event. Then it occurred to me that the 'machine' was sending him a message that they didn't want him and they turned the air conditioning off to embarrass him with the media. So why didn't Gore get the message? He's a young man, who's whole life was geared towards being President. His father was a Senator and he believes he was destined to be President. He came so close and yet he lost it. He's not going to just go out in a pasture and eat grass. He keeps trying and will keep trying to get back in the game so he can run again. Now we come to 2004 and Gore decides for whatever reason not to run, perhaps he was promised something, perhaps he's bidding his time for 2008. Whatever the reason he announces that he's not running and all these other guys are fighting for it. Gore decides to endorse Dean. Dean is not the pick of the 'machine' either so perhaps Gore's decision was to try to help another outsider and poke his finger in the machine's eye. Whatever the reason, it doesn't change anything much either way.

I've previously said that Edwards is the 'machine's' pick and I stand by that. Just today we hear that some are questioning Edwards contributors. I think the machine is the source of his money. Drudge is even reporting that he overspent in NH, interesting isn't it.

Notice the trend. I've said previously that the machine doesn't want Kerry but they may have to take him if he makes it. But watch for the actual numbers on Tuesday. If Edwards wins or shows a strong second then my predictions still hold. Edwards should do better in the south and the next big day is Feb 3rd when a whole bunch of states have their primaries. While Dean would have been the dream candidate for Bush another possibility exists and that is a tie. If no candidate gets the required number of delegates to the convention then all hell will break loose. If the dems don't decide on a single candidate then they will be spending all their time and money fighting each other until the convention and that would be a disaster for them. If they pick one candidate then that person can spend the summer running ads and stuff against Bush instead of beating up on each other. I prefer the former because I always like to watch turmoil in the democrat party and it would help to ensure an even bigger win for the reps in November.

The thing to consider about 2004 is not which candidate you prefer but which one those in the middle prefer. The core groups in each party will vote their party line. That is about 25% for each party. Then the next 15% for each party is softer but likely to vote the party line. A weak candidate could lose some of that 15%. The last 20% are those unaffiliated voters who will make the real difference. I think the dems are making a huge mistake saying they want to rescind the tax break, even though some of them say only for the rich. Many people will think that while they 'say' it is only for the rich they could easily change their minds and raise their taxes too. You can't win any election telling the voters you're going to raise their taxes. Also the anti-war talk will be perceived by some to think that the dems are weak on providing safety for the homeland. Whether these are true or not the fact that the dems are making such an issue of it will cost them votes from the middle in November. I think the real problem for whoever the dem candidate is all the statements made in the primaries will be remembered and used in the general and that can only hurt them.

But then, that's just my opinion.

More proof of the democrats smear plot in case you still didn't believe it. This is no different than Peter Knapp, a republican, using his power while Preble's supervisor, using Doug Staley to harass private citizens. This offends me and my feelings about being an American. Public officials, no matter what rank, should only use their power for the public good, not for political or personal gain. It is sad to realize that Palm Beach County state attorney Barry Krischer, a democrat, will be looked on favorably by democrats for doing this.

Limbaugh Prosecutor a Janet Reno Democrat

Palm Beach County state attorney Barry Krischer, whose office announced yesterday it has seized the medical records of top radio host Rush Limbaugh, is a Democrat who strongly supported frequent Limbaugh target Janet Reno when she was nominated to be U.S. attorney general in 1993.

"I think she's highly qualified, and believe the manner in which she's handled high-profile cases ... shows she's got the courage and integrity to do the job," Krischer told the Orlando Sun Sentinel after the Clinton administration nominated his Dade County colleague.

Krischer's praise came as police who served under Reno slammed her as incompetent. "Local law-enforcement [officials] are going to be glad to see her go," an FBI agent told the paper.

Miami, FL ? January 23, 2004 ? Roy Black, attorney for Rush Limbaugh, issued the following statement today regarding confidential correspondence that was released to the media by Palm Beach State Attorney Barry Krischer.


?My letter to Mr. Krischer regarding Mr. Limbaugh?s case asked that Mr. Limbaugh be afforded the treatment anyone else would receive. The State's response was preposterous, but consistent with their double standard in this case. The facts are: Mr. Limbaugh went to these doctors to relieve chronic, intractable pain; there was no doctor shopping. Mr. Limbaugh never considered accepting the State?s ludicrous offer. He was not going to plea to something he did not do. We sent them a letter suggesting Mr. Limbaugh be treated in a similar manner that others had been treated. They responded with a preposterous offer. Discussions ended at that time. At no time was there ever a plea agreement of any kind.

'What the records don?t show is that before we could draft a letter responding to the State, we received a phone call from a newspaper reporter, as a result of a leak by the State Attorney?s office, asking us whether Mr. Limbaugh had agreed to enter a plea. As I told the court last month, we think the State Attorney?s Office should be investigated for journalist shopping.

'What is most troubling here is the continued violations of Florida law and bar ethics by the State Attorney?s Office. One need look no further than the bold caption on top of my letter alerting everyone to the confidential nature of the communication. The disclosure of these highly confidential communications violates the Florida statutes, the rules of procedure and evidence, and the Florida Bar Rules governing professional conduct. Because the State has no case against Mr. Limbaugh they continually seek to discredit him in the media.?
Palm Beach State Attorney Barry Krischer is a democrat, which should surprise no-one. This is a blatant attempt to silence Rush for the democrats political gain and I am not going to forget this.
